Mesothelioma is a deadly cancer that affects people who have
been exposed to asbestos. This slow forming cancer is not just a
frightening and often fatal disease; it is also a financially
draining disease. The medical expenses that may or may not be
covered by medical insurance, the loss of income when a patient
can't work, and even compensation for pain and suffering have
become grounds for a mesothelioma claim. Many claims become
Mesothelioma settlements rather than ever going to court.
Mesothelioma patients and their families are making claims and
collecting Mesothelioma settlements from the employers, asbestos
producing companies and any other entity that could be found
responsible for the patient's exposure to asbestos. Mesothelioma
often doesn't develop until 40 or more years after exposure, so
it can seem as if filing a claim for something that happened so
long ago would be useless. It's not; there are manufacturers of
asbestos and large companies that answer for these mistakes that
were made so long ago. They can't take back the exposure, or
heal the cancer, but they can compensate the victims.
Filing a mesothelioma claim is generally for the purpose of
recovering damages incurred from contracting the disease. This
includes medical expenses, loss of income, and pain and
suffering. This is considered a personal injury claim that is
filed by the patient, either individually or through a
mesothelioma attorney. Another claim is one made by the family
after a victim has passed away this is called a wrongful death
claim.
A mesothelioma lawyer is prepared to assist mesothelioma
victims in submitting a claim and even following through with
litigation against the company or companies responsible for the
asbestos exposure that caused the mesothelioma. Attempting to
file a mesothelioma claim without seeking legal advice is not
advised. Mesothelioma lawyers know the process and what to
claim, including the items listed above as well as other
expenses.
Mesothelioma attorneys Waters & Kraus are responsible for taking
more mesothelioma and asbestos claims to trial than any other
firm in the country. Attorneys who specialize in mesothelioma
and asbestos related claims are needed in order to avoid
becoming intimidated or settling for less than you are entitled
to just to avoid the hassles of a trial.
Mesothelioma attorneys make sure that the patient and the family
gets everything they are entitled to and don't jump at a
settlement offer because they know the true cost this disease
has wrung from the victim. They are willing to stand their
ground and take the claim to trial if need be in order to make
sure that their client is awarded what they deserve.
Many times the company or companies will want to avoid both the
expense and hassle of a court battle and will offer a settlement
to the mesothelioma patient through the attorney.if accepted may be quite
large and are often paid in monthly or quarterly installments,
however settlements rarely actually cover all the costs included
in a claim. Patients and families need to be aware that court
cases are expensive as are special attorneys and all of those
costs will have to be deducted from the settlement or judgment.

An Introduction to Mesothelioma
Tragically the word mesothelioma is becoming more and more well
known, the mere mention of it striking fear into all of us for
we know that it is associated with death. Asbestos is the
reaper, mesothelioma its hand maiden.
Asbestos, the wonder product of the fifties is now recognized as
an enemy of the twentieth century. A ruthless enemy which will
kill more people than the war. Men, women and children will fall
victim to its prey, innocents who have at some time in their
lives inhaled asbestos dust.
Most of us have been in contact with products containing
asbestos in our life times. We sat in asbestos class rooms,
stood beside our fathers as they cut asbestos fencing, pulled up
old linoleum with asbestos clogged to the back of it. Visited
the local tip where broken sheets of it lay open to the wind.
Records show that there are a higher number of people afflicted
with asbestosis and mesothelioma who have directly worked in
asbestos mines, ship yards and companies making products from
asbestos; however there are a large number of people afflicted,
who have never worked in these industries. Their contact with
asbestos, due to the dust brought home on their husband's
clothes or from the asbestos tailings placed around mine houses
and town perimeters. But the tragedy does not end there,
children innocently playing in their own back yards played
amongst the asbestos tailings as children elsewhere play in the
sand. They had no way of knowing that their sand was asbestos
blue. A good bath at the end of the day may have removed the
dust from the skin but the dust in the lungs remained and would
lay dormant for many years before claiming its deadly legacy.
Without warning, a healthy individual suddenly becomes short of
breath, x-rays reveal fluid on the lungs and the night mare
begins. Questions are asked and you answer, Yes, I was exposed
to asbestos dust but I was only in the town for a few short
months and that was over 40 years ago. How can this be? This is
the most perplexing thing about mesothelioma. Why is there such
a long period of time between inhalation of asbestos dust and
onset of the disease? What triggers a strong healthy body to
suddenly succumb to it? What can we do to prevent this from
happening?
Blood tests are now available to determine whether mesothelioma
is present in the body, before a person is aware of any
symptoms. This is an amazing breakthrough and perhaps the first
step towards curing the disease before it becomes terminal.
Recently mesothelioma was cured in a mouse and attempts to give
it back to the mouse were unsuccessful. This too is exciting
stuff and holds a glimmer of hope for us all.

Treating Mesothelioma
Clinical research to treat malignant mesothelioma is very active
and although no treatment has yet proved entirely successful,
there exist a range of treatments available to individuals
diagnosed with the disease. There are three types of standard
treatments used to treat malignant mesothelioma which include:
surgery, radiation therapy, and chemotherapy.
Surgery Surgery for malignant mesothelioma is divided into a
number of sub-classes, which are specially designed to limit the
disease for individuals with particular strains of the disease.
Extrapleural pneumonectomy is a severe form of surgery in which
the entire lung and a portion of the lining of the chest, the
diaphragm, and some or the entire sac which surrounds the heart
is removed.
Wide local excision is a form of surgery which targets and
removes the cancer and a limited amount of the healthy tissue
surrounding the cancerous region.
Pleurectomy and decortication removes part of the covering of
the lungs, as well as the lining of the chest and portions of
the outside covering of the lungs.
The surgical procedure pleurodesis is a distinct technique
insofar as it employs a blend of chemicals and/or drugs to
create an intentional scar between the layers of the pleura.
Post surgery, the space created by the scar must be drained,
using either a catheter or chest tube, and is then filled with a
chemical which inhibits the accumulation of fluid in the pleura
cavity.
Radiation The second primary medical technique used to fight the
development of malignant mesothelioma is radiation. Radiation
therapy, as applied to malignant mesothelioma uses the same
basic technology as other forms of medical radiation insofar as
the technique employs high energy x-rays to kill cancer cells.
The process is divided into two broad categories:
External radiation therapy is a technique in which a machine
sends radiation in a targeted stream at a certain portion of the
body, and in so doing it kills the cancerous cells in its
purview.
Internal radiation therapy, by contrast, uses not an external
machine, but rather needles, seeds and catheters to place
radioactive substance directly on or near the cancer. While the
precise method of implementation will of course depend upon the
type and stage of the illness, what is constant within this
category is that the goal is to get the radiation placed
directly onto the cancerous area and in so doing provide a more
concentrated and directed dosage.
Chemotherapy The third standard malignant mesothelioma treatment
is Chemotherapy. Chemotherapy uses drugs which target cancer
cells and stop them from dividing and thus prevent their growth.
In systemic chemotherapy, the drug can be taken by mouth or
injected, but either way the goal is to have it reach cancer
cells by means of the body's own blood circulation system. In
regional chemotherapy, the drug is placed directly onto the
target area. And finally, combination chemotherapy involves the
use of two or more anticancer drugs which can be administered
either orally or through injection.
Malignant mesothelioma is a difficult disease for anyone to
bear, however, educating oneself as to the options available is
an important step for making the process more manageable.

Is Mesothelioma Preventable ?
Mesothelioma is a type of cancer that is caused by exposure to
asbestos. This disease attacks the protective lining that covers
most of the body's internal organs and in almost all cases is
fatal, although new treatments for cancer are always
underdevelopment giving us hope we may live cancer free sometime
in the future.
You can avoid mesothelioma by not exposing yourself to asbestos.
Typically a worker was exposed to asbestos on their job. In the
past asbestos was widely used in the large industrial
manufacturing industry, the automotive industry and the heating
and ventilating industry. Typical exposure is from inhaling
asbestos dust a by product of manufacturing. When the worker
goes home, their family experiences secondary exposure to the
asbestos dust on their clothing.
In residential construction during 1960's and 1970's, asbestos
was commonly use to seal leaks and seams on heating ducts in
residential houses and in other heating and ventilation systems.
Exposure to asbestos dust comes when the asbestos seal begins to
breakdown and gives off the deadly asbestos dust particles. So,
if you are buying an older home, be certain to have it inspected
for asbestos. If found, asbestos can be removed or sealed with a
protective cover to prevent exposure to humans.
Detection of mesothelioma and drawing the connection between
work-related hazards wasn't always realized. It has only come to
light recently that large corporations were negligent in
exposing their workers to asbestos dust. This is due to the fact
that it takes some time for the cancer to form. Most families
were so consumed with helping their loved ones; they failed to
realize the cancer they were battling was actually caused by the
working conditions of a loved one.
If an individual was exposed to asbestos during their working
career then the corporation employing them is at fault and is
responsible for the damages resulting from the asbestos caused
mesothelioma. Individuals and families battling mesothelioma and
facing the loss of a loved one need realize and understand their
legal rights.
If you or a loved one has been diagnosed with mesothelioma then
you need to consult with a mesothelioma lawyer to understand
your legal rights. This type of lawyer is experienced with
asbestos related cases and taking on the large corporations and
winning. Typically, a mesothelioma lawyer will review your case
at little or no charge to evaluate if you have a case. If it is
determined you do they will handle the lawsuit for damages from
the corporation responsible.
It is a shame to think your life or a loved ones life is cut
short due to the negligence of a corporation not controlling the
exposure to asbestos. You may be uncomfortable with a lawsuit,
but it is your legal right to seek adequate compensation for
your life or a loved ones being cut short and the resulting
impact of not being able to provide for the family any longer.
Asbestos caused mesothelioma is a preventable disease and it's
sad to think an employee who works hard for a corporation is
actually killed slowly by the exposure to asbestos. If you're
dealing with mesothelioma in your life, seek the help of a
mesothelioma lawyer to ensure your financial future peace of
mind while you and your family deal with the loss of a loved
one.

The Treatment Methods of Pleural Mesothelioma
The on-going development of new drugs and detection techniques is improving the outlook for patients with pleural mesothelioma. Since pleural mesothelioma is the most common form of the cancer, more research and knowledge about this type of mesothelioma is present to utilize when detailing a treatment plan.
In general, pleural mesothelioma patients have three options: surgery, chemotherapy and radiation therapy. Typically, patients will receive a combination of two or more of these types of treatment.
Understanding available treatment options is often very important to patients and their loved ones. We offer a complimentary informational packet detailing treatment options for pleural mesothelioma patients. Click here to receive your packet overnight or call 800-615-2270 to speak with a patient and family advocate available at no charge to answer questions and offer guidance.
Early detection of pleural mesothelioma can improve a patient's mesothelioma prognosis considerably, and these patients have more extensive treatment options. If the disease is diagnosed early enough, surgery to remove localized tumors, followed by chemotherapy or radiation therapy to kill any remaining cancer cells can be an effective treatment. Curative surgery candidates must be in a good general state of health, and their cancer must not have spread beyond localized sections of the lungs.
When mesothelioma is diagnosed before the cancer has greatly progressed, a patient is typically in the first stages of mesothelioma. Doctors typically address the seriousness of cancer in terms of stages ranging from one to four, with the level of the cancer’s progression increasing with each stage. Patients diagnosed with pleural mesothelioma in stage one or two generally have greater treatment options and a better prognosis.
According to some current studies, approximately 10 percent of all pleural mesothelioma patients will survive for three to five years following diagnosis, and about 5 percent will survive five years or more.
Pleural mesothelioma patients who are not diagnosed early enough for curative treatment have fewer treatment options, mostly limited to palliative treatments, designed to relieve pain and discomfort to improve a patient's quality of life, rather than their prognosis. Palliative treatments include removal of built-up fluid from the pleural spaces, and surgical removal of tumors to relieve pressure on the lungs.

The Diagnosis of Pleural Mesothelioma
As with other types of mesothelioma, pleural mesothelioma is difficult to diagnose since symptoms do not typically arise for some time after initial asbestos exposure occurs. Additionally, since the symptoms of pleural mesothelioma are typical of many illnesses, in the early stages of the cancer the symptoms are often mistaken for less threatening diseases such as influenza and pneumonia.
X-rays or CT-Scans are often used to diagnose pleural mesothelioma.
A pleural mesothelioma diagnosis is made partly on the basis of symptoms but additional diagnostic tests are needed to confirm the presence of cancer. Following a medical history review and physical examination, patients must typically undergo imaging tests, such as x-rays or CT scans, to confirm the location of cancer. A patient must also usually endure fluid and tissue tests, also known as biopsies, to confirm the type of cancer involved.

The Symptoms Of Pleural Mesothelioma
Once trapped in the body, asbestos fibers cause cancerous cells to divide abnormally, resulting in the thickening of the pleural membrane layers and mesothelial cells, causing build-up of fluid (called pleural effusion). The fluid begins to put pressure on the lungs and the respiratory system in general, preventing normal breathing. Symptoms of pleural mesothelioma are largely caused by these developments and may include the following:
Pleural Mesothelioma Diagram
Pleural mesothelioma specifically develops in the pleural lining of the lungs.
* Persistent dry or raspy cough
* Coughing up blood (hemoptysis)
* Difficulty in swallowing (dysphagia)
* Shortness of breath that occurs even when at rest (dyspnea)
* Persistent pain in the chest or rib area, or painful breathing
* Development of lumps under the skin on the chest
* Night sweats or fever
* Unexplained weight loss
* Fatigue

The History Of Mesothelioma
Malignant mesothelioma remains one of the sentinel malignancies of oncology. It has a breathtakingly rapid natural history with a median survival of 6 to 8 months when untreated, is environmentally related, and has such economic and social impact that attorneys specialize in representing only mesothelioma patients. Expert witnesses devote full time to testifying, and governments are forced to consider not only the banning of the environmental agent but also a reappraisal of the whole tort system for compensation to injured victims. Furthermore, its presence in certain populations has changed the mindset of whole communities, such as Libby, Montana, Cappadocia, Turkey, Sarnia, and Ontario. Because of its infrequent occurrence, malignant mesothelioma is considered an orphan disease and managed in an anecdotal fashion in most oncologic practices. Yet this disease has set new scientific paradigms— in the clinic, laboratory, and community.
Over the last ten years, data have accumulated indicating that mesothelioma is a cancer caused by the environmental carcinogens asbestos and erionite, which interact with genetic predisposition and viral infection during cardinogenesis. The outcome of these complex interactions determines who among exposed individuals will develop
malignancy. Moreover, mesothelioma has become the ideal model to study how genetics and viral infection influence environmental carcinogenesis, as well as to discover novel targets for early detection and therapy.
Few cancers have caused so much controversy as mesothelioma. For more than 40 years scientists have argued whether chrysotile asbestos does or does not cause mesothelioma.Besides these important causality issues, conflict exists regarding the best surgical therapy for the disease and the interpretation of novel trials for mesothelioma.
The proliferation of mesothelioma-specific knowledge has led to an increase in the number of global conferences devoted to mesothelioma, at which scientists present new and exciting findings. Asufficient quantity of mesothelioma-specific research now stands strong and is no longer the stepchild at meetings devoted to lung cancer or sarcoma. Clinicians and scientists alike are being identified as “mesothelioma
experts,” and their advice in preventing and detecting the disease early, as well as in the treatment of the disease, is being solicited not only by other physicians, but by a growing number of E-mails directly from patients and their families.

What is Mesothelioma ?
The U.S. government reports that 70% to 80% of all cases of mesothelioma occur in people with atraceable history of exposure to asbestos. These numbers are from epidemiological surveys. There is a good chance that many of the remaining mesothelioma cases are also due to asbestos, but that the patient could not identify exactly where or when the asbestos fiber exposure occurred. Mesothelioma is a very tough cancer. Most patients undergo surgery and chemotherapy.
Sometimes radiation therapy is employed, including innovative techniques such as tomotherapy and intensity modulated radiation therapy. Oncologists use Brachytherapy for targeted radiation treatment of the tumor. The antifolate drug pemetrexed (Alimta) in combination with cisplatin has been embraced by many mesothelioma specialists. Median survival time, even with good medical care, is fairly low. Effusions into the bodily cavities is a common symptom. The chest, or pleural cavity, gets effusions, as well as the peritoneal (abdominal) cavity, depending on the site and shape of the tumor. Mesothelioma is classified as either pleural (the most common type) or peritoneal, depending on the location of the disease.(There are other types, but pleural and peritoneal are the most common.) To diagnose mesothelioma, the doctor takes a sample, usually of the pleural fluid, and conducts a biopsy in a lab. Immunohistochemical markers are employed in biopsy to distinguish mesothelioma from adenocarcinoma. These markers are usually glycoproteins. Other markers can be detected in the blood to help identify mesothelioma. Soluble mesothelin-related (SMR) proteins released by mesothelioma cells are distinctive enough to show up in the blood, if the appropriate test is conducted. However, definitive diagnosis still requires a laboratory biopsy. Tests and trials with gene therapy and immunotherapy are sometimes done on mesothelioma cases, but the standard cancer treatment modalities of surgery, radiation, and chemotherapy remain the most used techniques in mesothelioma treatment.
